The Fifth Circuit Court of Appeals sided with SpaceX earlier this week, ruling that the National Labor Relations Board’s current structure is unconstitutional. The decision will keep the agency hamstrung until the case makes its way to the Supreme Court.
It boggles the mind to argue that because the president is charged with faithfully executing the law there can’t be a law that limits a president’s authority to arbitrarily fire officials. All of these protected positions can be removed for cause. If these officials are not faithfully executing their duties in accordance with the law, that would be cause to remove them!
The problem is always that management needs to engage in some amount of work to identify people to fire “with cause” and then justify that firing. These guys don’t want to fire because they built a case. They want to just Vibes Manage and do as they please. You’re guilty because I say you’re guilty. You’re fired because I say you’re fired. I win because I say I win.
For the petty aristocracy of the modern American upper class, any third party bureaucrat who steps in between them and their libidinal desires is an infringement on their God Given Right to Do As Thou Wilt.
The strong do as they please and the weak suffer what they must.
Not gonna stop until they find out how that worked for the Athenians.
